Breeding Agreement

This agreement being made by and between Kathryn Smith, DBA Touch O’ Glory Appaloosa’s here after referred to as Breeder. And the Mare Owner described below.

To, NW’s North Canyon, (here after called Stallion) ApHC# 523181, for the 2007 breeding season.

The following terms and conditions apply:

I The breeding fee of $650.00 shall be paid by the Mare Owner to the Breeder
a) The sum of $250.00 payable before or upon arrival of above said mare to the Farm or
before any semen shall be shipped
b) The additional sum of $250.00 shall be paid after mare is found to bein foal, or before
October 1, 2007
c) The remaining sum of $150.00 shall be paid after birth of resulting Live Foal.
d) Upon receipt of payment in full, registration application shall be provided to Mare
Owner by the Breeder.

II The following additional terms and expenses are for fresh cooled semen:

a) A collection fee of $150.00 must be paid to Breeder prior to any and each shipment.
b) Collection fee includes…collection (performed by a licensed Veterinarian), container
use and expenses incurred for delivery of container to currier.
c) Currier charges will be billed directly to the Mare Owner, when this is not possible,
billing will come through the Breeders billing system.
d) An additional $150.00 will be charged if airport drop off is necessary.
e) Breeder is responsible for delivery to the currier only and shall not be held liable for
any delays or damages beyond that destination.
f) All shipping expenses shall be paid at time of billing and must be paid in full prior to
any additional shipments.

III The following pertains to mares being brought to Breeders designated Farm for breeding:

a) Mares brought to the Farm, must have the result of a current negative Coggins.
Veterinarian’s Health Certificate noting the above named mare is breeding sound.
b) Breeder reserves the right to approve the mare before breeding.
c) Mare care shall be at the rate of $5.00 dry and $6.00 wet per day.
d) Mare must be broke to halter and tie.
e) Breeder reserves the right to use a humane twitch if necessary to insure the safety of
Stallion, Breeder, and handler. Breeder is not responsible for a mare that will not be
bred.


IV The Breeder reserves the right to obtain Veterinary and hoof trimming services as
necessary.
a) Mare must not be shod at the time of breeding.

V Breeders shall exercise reasonable care for health and safety of mare (and foal).
a) In the unfortunate event of injury, to said mare or foal. Mare Owner agrees to assume
full financial responsibility for care and Veterinary services.

VI Mare Owner agrees to hold harmless and indemnify the Breeders, their family, farm, property
owners, their employees, or anyone associated with the Breeders/Farm for any injury, sickness,
death, loss, theft or damage to or incurred by said mare (and foal).

VII Insurance for the mare, (and foal) if any shall be the sole responsibility of the Mare Owner.

VIII The Mare Owner shall not be responsible for damage (if any) to the stallion by the mare during
breeding.

IX Fees are non refundable.

X Breeder offers a Live Foal guarantee.
a) A Live Foal is defined as one that stands to nurse.
b) In the unfortunate event that the mare dose not produce a live foal.
c) The Mare Owner may rebreed one (1) time at no additional service fee (only M/C,
collection and currier fees apply).
d) The mare maybe rebred the same or the following breeding season.
e) A certificate from the attending Veterinarian stating reason for death and or loss of
said foal.
f) The Veterinarian must also affirm the fact that the mare was properly
cared for, during gestation.
g) This must be supplied to the Breeder, and accompany any request, for rebreed or
additional semen.

Non- Assignment:

This contract cannot be assigned or transferred by the Mare Owner. If the mare is sold or transferred after having been serviced by the stallion, there shall be no rights of return to the stallion without the express written consent of the stallion owner.

Appended hereto and made an integral part hereof is a Mare Information Form, the completion and truth of which is an essential consideration of this contract.

This contract is signed by the respective parties at the places and on the dates set forth below. This constitutes the entire agreement between the Mare Owner and the Breeder and the same may not be amended or modified, except by mutual exchange of written instruments by both parties. In the case of litigation all parties agree that Idaho will be the Forum State and that Boundary County, Idaho Law will be applied to this contract.
